The specific services to be provided will be outlined in a written quote or service agreement provided to you prior to commencement of work. This may include services for cottage plots, country homes, townhouses, commercial properties, new developments, and neglected gardens.

2.2 Service Scheduling

Our standard business hours are Monday through Friday, 9:00 AM to 8:00 PM. Service appointments will be scheduled by mutual agreement. We will make reasonable efforts to accommodate your preferred timing.

2.3 Access to Property

You agree to provide safe and reasonable access to your property for the performance of services. This includes ensuring clear pathways and notifying us of any hazards, underground utilities, or restrictions that may affect our work.

3. Pricing and Payment

3.1 Quotes and Estimates

All quotes provided are valid for the period specified in the quote document. Prices may be subject to change based on the actual scope of work required, which may differ from initial assessments.

3.2 Payment Terms

Payment terms will be specified in your service agreement. Unless otherwise agreed in writing, payment is due upon completion of services or according to the schedule outlined in your agreement.

3.3 Additional Work

Any work requested beyond the original scope will be quoted separately and requires your approval before commencement.

4. Cancellation and Rescheduling

4.1 Client Cancellations

If you need to cancel or reschedule a service appointment, please contact us as soon as possible. Cancellation policies and any applicable fees will be communicated at the time of booking.

4.2 Weather-Related Changes

Gardening services are subject to weather conditions. We reserve the right to reschedule services when weather conditions make work impractical or unsafe. We will contact you to arrange an alternative date.

5. Client Responsibilities

You agree to:

  • Provide accurate information about your property and service requirements
  • Ensure pets and children are kept at a safe distance during service delivery
  • Inform us of any relevant property regulations, homeowner association rules, or local bylaws that may affect our work
  • Maintain communication regarding any changes to your requirements

6. Our Responsibilities

We agree to:

  • Perform services with reasonable care and skill
  • Use appropriate materials and equipment
  • Communicate clearly about service schedules and any issues that arise
  • Respect your property and clean up work areas upon completion

7. Limitations of Liability

7.1 Plant Health

While we exercise professional care, we cannot guarantee the survival or growth of plants, which are affected by numerous factors including weather, soil conditions, pests, and diseases beyond our control.

7.2 Pre-Existing Conditions

We are not liable for damage resulting from pre-existing conditions of plants, structures, or property that were not disclosed to us or were not reasonably discoverable.

7.3 Maximum Liability

Our liability for any claim arising from our services shall not exceed the amount paid for the specific service giving rise to the claim.

8. Property Damage

We take care to protect your property during service delivery. If damage occurs as a direct result of our negligence, please notify us within a reasonable timeframe. We will assess the situation and work with you to reach a fair resolution.

9. Intellectual Property

Any garden designs, plans, or documentation we create remain our intellectual property until full payment is received. Upon payment, you receive a license to use these materials for the intended purpose on your property.

10. Privacy

We collect and use personal information in accordance with our Privacy Policy. By engaging our services, you consent to the collection and use of information as described therein.

11. Termination

Either party may terminate an ongoing service arrangement with written notice. Any services rendered up to the termination date remain payable.

12. Dispute Resolution

In the event of a dispute, we encourage you to contact us first at contact@directvalue.org to seek an amicable resolution. If a resolution cannot be reached, disputes will be handled in accordance with applicable laws in Canada.

13. Amendments

We reserve the right to modify these Terms and Conditions at any time. Changes will be posted on our website. Continued use of our services after such modifications constitutes acceptance of the updated terms.

14. Severability

If any provision of these Terms and Conditions is found to be unenforceable, the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms and Conditions, together with any service agreement or quote provided to you, constitute the entire agreement between you and Directvalue regarding the services described.
